  1. Standard Terms & Conditions of Sale

    RECITALS:

    These terms and conditions of sale are made between, SEB INTERNATIONAL SERVICE, registered at the Vesoul Register of Companies under number 399 014 216, located rue des Chars, Faucogney-et-La-Mer (Haute-Saône), hereinafter “SIS”, and any individual purchasing on the SIS web site (http://www.accessories.home-and-cook.com or http://www.accessoires.home-and-cook.fr, hereinafter the “Site”), hereinafter the “Customer”.

    Please note that we are only able to deliver to addresses in the United Kingdom. All deliveries must be signed for.

    The price of the goods and/or services and delivery charges are inclusive of VAT. The VAT is charged at published UK rates for the supply for the UK territories at the time of order. Exports to the Isle of Man are charged at UK tax rates as per HM Revenue and Customs (HMRC) guide lines

    The parties agree that their relationship will be governed by these Terms and Conditions of Sale and the Terms & Conditions of Use of the Site, available on the Site, to the exclusion of all other conditions.

    You are going to enter into a purchase agreement. Please read the Standard Terms and Conditions before accepting. Please note that the Standard Terms and Conditions are in English. After entering into the contract by clicking on the “I agree the Terms and Conditions” box, SIS will send an email confirming the sale, which you may print and save as evidence of the purchase. SIS will also keep the document as proof of the purchase.

    Purpose:

    The purpose of these terms and conditions is to specify the modalities of any sale between SIS and the Customer, specifically in relation to the ordering, services, payment and delivery. They govern all the steps necessary for orders to be placed and tracked between the contracting parties.

    In checking the “I agree the Terms and Conditions” box, you agree to be bound by these Terms & Conditions of Sale. If you do not agree to these Standard Terms and Conditions of Sale, you will be unable to confirm your order.
     

    1. Ordering:

      Orders can only be registered on the site if the Customer is clearly identified by entering a specific user name (his/her e-mail address) and password which are both strictly confidential. Any order placed via a user name and password will be deemed as validly issued.

      SIS undertakes to deliver any order received on its web site solely subject to the availability of the products. If a product is not available, SIS undertakes to inform the Customer of such unavailability.
       

    2. Delivery:

      The orders will be delivered to the address provided by the Customer upon its registration or when placing the order.

      Please note that we are only able to deliver to addresses in the United Kingdom. All deliveries must be signed for.

      Deliveries are made via carrier within a maximum period of 7 working days.

      The delivery cost is £3.00 per order to UK addresses all taxes included.

      If the Customer is absent, the carrier will leave a card, indicating where and when the parcel may be collected.

      In all instances, it is essential that you check the condition of the parcel as well as its content. If the condition and/or content of the parcel are defective, the Customer should refuse the delivery and make the following statement on the receipt “Rejected due to bad condition”, sign it and add the date of receipt of the parcel. At the same time, the Customer Relations Department should be contacted by telephone on the following number: 0345 601 1232 A new parcel will be delivered within a maximum period of 7 working days from the date on which the Customer rejected the first delivery.

      If the parcel is found to be defective subsequently to the delivery, the Customer may return the product in accordance with the conditions set out in article 5) 1 below.

      Services

      SIS offers to its Customer additional services free of charge:

      • Home deliveries are made regardless of the location, and specifically the stairway, with the exception that the carrier should have sufficient space available to deliver the products ordered.
      • The Customer can ask any question and settle any problem regarding its relationship with SIS by calling the Customer Relations Department on the following number: 0345 601 1232.
         
    3. Terms of payment:

      The purchases must be paid on-line, when ordering, by Visa card or MasterCard.

      SIS makes every effort to ensure the confidentiality and security of data sent over the web. In this regard, the web site uses a secure SSL (Secure Socket Layer) payment module.
       

    4. Prices:

      Prices are indicated in Pounds Sterling all taxes included. They include VAT applicable on the date of the order. These prices do not however include the cost of carriage.

      Prices are firm at the time the Customer places the order within the limit of available stocks.
       

    5. Returns:

      1. Guarantee 

        Home&Cook Accessories guarantees original accessories, spare parts and utensils against any manufacturing defect in materials or workmanship during 2 years in the country of purchase, starting from the initial date of purchase or delivery date, with the exception of the spare parts that do require specific tooling or technical know-how to fit, which will have only a 3 month commercial guarantee.

         

        This guarantee covers all costs related to restoring the proven defective product so that it conforms to its original specifications, through the repair or replacement of any defective part and the necessary labour. At Home&Cook Accessories’s choice, a replacement product may be provided instead of repairing a defective product. Home&Cook Accessories ‘s sole obligation and your exclusive resolution under this guarantee are limited to such repair or replacement.

         

        Conditions & Exclusions

        Home&Cook Accessories shall not be obliged to repair or replace any product which is not accompanied by a valid proof of purchase. After calling the Consumer Contact Centre for the UK at 0345 602 1454 and for ROI at 01 677 4003  and obtaining an approval for return, the product must be adequately packaged and returned, by recorded delivery (or equivalent method of postage), to Home&Cook Accessories (address confirmed when getting a return agreement by our Consumer Contact Center). Following confirmation of the defective product, Home&Cook Accessories will either send back a repaired product or a new one. Non defective parts will be sent back to the claimant at his request and at his cost.


        In order to offer the best possible after-sales service and constantly improve customer satisfaction, Home&Cook Accessories may send a satisfaction survey to all customers who have had their product repaired or exchanged by an authorised service centre.

         

        This commercial guarantee applies only for products purchased and used for domestic purposes and will not cover any damage which occurs as a result of misuse, negligence, failure to follow Home&Cook Accessories instructions, or a modification or unauthorised repair of the product, faulty packaging by the owner or mishandling by any carrier. It also does not cover normal wear and tear, maintenance or replacement of consumable parts, or the following:

        - using the wrong type of water or consumable                                         

        - damages or poor results specifically due to wrong voltage or frequency as stamped on the product ID or specification

        - scaling (any de-scaling must be carried out according to the instructions for use)

        - accidents including fire, flood, thunderbolt etc

        - mechanical damages, overloading               

        - ingress of water, dust or insects into the product

        - damage to any glass or porcelain ware in the product

        - professional or commercial use

        - stains, discolouration or scratches              

        - use in an oven (except products specifically designed for this)

        - if the product is knocked or dropped

        - burns caused by exposure to heat or flame              

        - cleaning in a dishwasher (except products specifically designed for this)                         

        - damage from thermal shocks

                                      

        Consumer Statutory Rights

        This guarantee does not affect the Statutory Rights a consumer may have or those rights that cannot be excluded or limited, nor rights against the retailer from which the consumer purchased the product. This guarantee gives a consumer specific legal rights, and the consumer may also have other legal rights which vary from State to State or Country to Country. The consumer may assert any such rights at his sole discretion.

         

         

        We advise clients to respect the use-by date included in food and cosmetic ingredients (ingredients with a use-by date used in the preparation of recipes).  Once the date has elapsed, the food and cosmetic consumables will not present any danger to health but may, on the other hand, have lost all or part of their qualities: taste, texture, etc. and/or be ineffective when they are used.


         

      2. Withdrawal

        2.1. Accessories and consumables* excluding food and cosmetic ingredients (ingredients with a use-by date used in the preparation of recipes):

         

        You have a right of withdrawal i.e. decline your purchase of a product from our site without having to justify your reason. If you wish to withdraw, your request must be made in writing (e-mail or letter) within 14 days of the date on which the product is received. It should include the following information: 

         

                - Your contact details: Ms/Mr name, address, tel. no...

                - to the attention: Groupe SEB UK Ltd, Consumer Service by letter to the address Riverside House, Riverside Walk, Windsor, Berkshire, SL4 1NA. 

                - I hereby inform you of my withdrawal in relation to:

        • the product........        
        • ordered on ......
        • order no. …………….
        • received on .......... (please find enclosed proof of date of receipt),

                               

         

        The product should also be sent to us (at your own expense), in its original packaging, to our warehouse at the following address : Groupe SEB UK Ltd, – Return service Home & Cook Accessories – Riverside House, Riverside Walk, Windsor, Berkshire, SL4 1NA, within 14 days of the date on which your letter is sent (the post office seal being valid) or e-mail informing us of your withdrawal.

         

        As soon as the product is received, we will refund any payments already collected, although you are still liable for any charges for returning the product. However, this does not apply to any returns not in their original packaging and which are incomplete, spoiled, damaged or used.

         

        * Consumables: component necessary for the use of the product which may be changed by the user without any special tools. There may be a notion of frequency in its replacement.

         

        2.2. Food and cosmetic ingredients (ingredients with a use-by date used in the preparation of recipes):

         

        Any right of withdrawal is excluded for products which may become damaged or go off quickly; therefore, the client does not benefit from any right of withdrawal in the case of these consumables (food preparations, cosmetic preparations, etc.).

         

      3. Other reasons

        In all other cases, a product may not be returned to SIS unless it has the formal and prior consent of the Consumer Service at 0345 601 1232. This return will be exchanged or replaced.

         

        In any situation, after the consent of the Client Service is given, the product must be sent back along with the various supporting documents to: SEB INTERNATIONAL SERVICE – Service Retours Home and Cook Accessoires - 70310 Faucogney et La Mer.

         

    6. Carrying out your purchase on line:

       

      In order to make a purchase on line via the web site, the Customer must complete a registration process to obtain his/her user name (the customer’s e-mail address and password).
       

    7. Liability/”Force Majeure”:

      SIS is under an obligation to achieve a result at all stages of the ordering and all stages subsequent to the execution of the contract. Accordingly, SIS undertakes to describe with the greatest care and accuracy the products sold on the SIS web site. However, SIS cannot be held liable if the non-fulfilment of its obligations if due either to an unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure, such as war, riots, lay-off, strikes, forces of God events, among others.
       

    8. Severability:

      If any clause in these standard terms and conditions is or becomes null or void due to a change in legislation, regulations or due to a court ruling, it shall not under any circumstances affect the validity of or compliance with the remaining clauses of these standard terms and conditions of sale.
       

    9. Proof:

      The electronic records retained in the information systems of SIS and its partners in reasonably secure conditions will be deemed as proof of the communications, orders and payments between the parties, without prejudice to the possibility for the Customer to bring proof to the contrary by any legally recognised means.
       

    10. Retention and filing of transactions:

      Order forms and invoices are filed on a reliable durable media in order to constitute a true and durable copy.
       

    11. Governing Law and Jurisdiction:

      These standard terms and conditions are subject to UK law.

      In the event of a dispute, the jurisdiction will be attributed to the courts of the defenders’ place of residence or, at the choice of the claimant, the place of effective delivery of the product.
       

  2. Terms and Conditions of Use of the Web Site

    Liability

    THE INFORMATION ON THIS SITE IS PROVIDED "AS IS", WITHOUT GUARANTEE OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED GUARANTEE OF MERCHANTABILITY, FITNESS OR PARTICULAR PURPOSE OR NON-INFRINGEMENT.

    SIS makes no guarantee or representations as to the accuracy or completeness of the information. SIS assumes no liability or responsibility for errors or omissions in contents, or in updating or correcting information on the site. Whilst SIS has made all reasonable efforts to ensure that the information provided through its web site is correct at the time of preparation, the company can give no guarantees about the accuracy of information obtained through this web site, including hypertext links, and reserves the right to make changes at any time, without notice.

    SIS will not be liable for any loss or damage resulting from the use of the internet and specifically from interruption of service, hacking or intrusion or the presence of computer viruses.

    SIS reserves the right to collect data on the User, specifically through the use of cookies.

    By using the sites www.accessories.home-and-cook.com and www.accessoires.home-and-cook.fr, the User accepts the use of his/her personal information, provided for upon its registration, by SIS’ departments in charged of the orders’ processing. These data are necessary to process orders. The User is informed that although these Terms and Conditions of Use of the Web Site are subject to UK law, in what regards personal information SIS as a controller is subject to French Law, the automated processing of information has been declared to the French Data Protection Authority (CNIL) under number 1246980. For commercial reasons and subject to the User’s prior authorisation, SIS may pass on the identity and contact details of Users of its services to its business partners.

    In accordance with the French Data Protection act, the User has the right to access, correct or delete data relating to him/her. He/she may also object to the transfer of his/her data to third parties.

    These rights may be exercised by e-mail at the address indicated by the Customer Relations Department c.f. article 5)1) or on the website in the field My Account.

    Intellectual property

    All components of the SIS web site whether visual or audio, including the underlying technologies, are the exclusive property of SIS and are protected by the law on intellectual property, trademarks and patents. Accordingly, any representation of all or any part of the Site without the express authorisation of SIS is prohibited and would constitute an infringement.

    The material on this site is designed for and may be downloaded only for your non-commercial personal use. In consideration of this authorisation, you agree that any copy of this site, or any material from this site, which you make shall retain all copyright, trademark or other proprietary notices contained herein. Any unauthorised use of the materials may subject the viewer to penalties or damages, including but not limited to those related to violation of trademarks, copyrights, privacy and publicity rights.

    All trademarks, service marks and logos found on this site are the registered or unregistered Marks of Groupe SEB. Nothing contained in this site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any patent or Mark displayed, without written permission by owner of the Mark.

    Protection of children (children aged 14 and under)

    SIS does not knowingly solicit or gather personal data supplied by children or relating to children (aged 14 and under) without the consent of a parent or tutor and does not knowingly sell its products or services to children. Please children under 14 years must send the consent of a parent or tutor. If it finds out that the person submitting personal data through any part of the SIS sites is a child, SIS will do everything that is reasonably within its power to ensure that those personal data are removed from its files as quickly as possible. SIS will also do everything that is reasonably possible to ensure that such personal data is not used for any purpose whatsoever or communicated to third parties. Given that it is does not seek to collect personal data relating to children and removes data gathered inadvertently as soon as it is so aware, SIS does not retain any data that might be subject to a right of access or removal. If a parent asks to access or remove data relating to its child before SIS has noticed the fact and removed the data, SIS will answer favourably to such request.
